Terms of Service
These Terms of Service (the "Terms") govern your use of the Embers mobile application (the "App") and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who We Are
Embers is an iOS application designed for couples to exchange private notes ("stickies"), whispers, affection cues, and other shared artifacts. The Service is provided by the Embers team ("we", "us", "our"). You can reach us any time at zfy3712z@gmail.com.
2. Eligibility
- You must be at least 13 years old (or the minimum age of digital consent in your country) to use Embers.
- If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to accept these Terms.
- Embers is designed for consenting partners. Do not use it to contact anyone who has not opted in.
3. Accounts & Pairing
- You sign in with Apple, Google, or email. You are responsible for keeping your account credentials secure.
- Each account may be paired with one partner at a time. If you need help with pairing or account access, contact us through the in-app support inbox or by email.
- You must provide accurate information (e.g. display name) and keep it updated.
4. Subscriptions & Payments
- Embers offers optional Pro purchases billed weekly, monthly, or as a one-time lifetime purchase via Apple In-App Purchase.
- Prices, free-trial lengths, and renewal terms are displayed in the App at the point of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- Manage or cancel your subscription any time from your iOS Settings → Apple ID → Subscriptions. Uninstalling the App alone does not cancel your subscription.
- Except where required by law, payments are non-refundable. Apple's refund policy applies to in-app purchases.
- If a feature you paid for stops working, contact us — we'll make it right.
5. Acceptable Use
You agree not to:
- Use the Service to harass, threaten, stalk, or abuse anyone, including your partner.
- Upload content that is illegal, infringes someone else's rights, or sexualizes minors.
- Reverse engineer, scrape, or attempt to disrupt the Service.
- Resell, sublicense, or commercialize any part of the Service without our written permission.
We may suspend or terminate accounts that violate these rules, with or without notice, at our discretion.
6. Your Content
- You retain all ownership of the stickies, whispers, images, support messages, and other content you create or choose to send ("Your Content").
- You grant us a limited, non-exclusive license to store, transmit, and display Your Content only as needed to operate the Service for you and your paired partner.
- For support messages and screenshots/images you send to us, you also grant us permission to review and reply to that content as needed to provide customer support, investigate bugs, and maintain the Service.
- You are solely responsible for Your Content and for obtaining consent from anyone depicted in it.
7. Intellectual Property
The App, including its code, design, illustrations, brand, and copy, is owned by Embers and protected by applicable intellectual-property laws. These Terms do not grant you any right to use the Embers name, logo, or trademarks.
8. Third-Party Services
Embers relies on third-party services, including Apple (Sign in with Apple, iCloud / CloudKit, APNs, In-App Purchase), Google (OAuth), and Supabase (authentication, storage, and backend). Your use of those services is also subject to their respective terms.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that messages will always be delivered on time.
10. Limitation of Liability
To the maximum extent permitted by law, Embers and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $20.
11. Termination
You can stop using the Service at any time by deleting your account from Settings → Delete account. We may suspend or terminate your access if we believe you have violated these Terms or if required by law. Sections that by their nature should survive termination (e.g. Intellectual Property, Disclaimers, Limitation of Liability) will survive.
12. Changes to the Terms
We may update these Terms from time to time. If a change is material, we'll notify you in the App or by email before it takes effect. Continued use of the Service after an update means you accept the new Terms.
13. Governing Law
These Terms are governed by the laws applicable at the operator's principal place of business, without regard to conflict-of-laws rules. Where consumer-protection law in your country provides stronger rights, those rights apply.
